Typically, adverse actions taken against employees of cities, counties, and special districts in a union or civil service environment are appealed through administrative trials known as arbitration (either advisory or binding) or before a council, board or commission. Appeals for private employees in a union environment are typically made through private arbitration as well. Adverse actions taken against employees of the State of California are generally heard by an Administrative Law Judge from the State Personnel Board (SPB) or the Office of Administrative Hearings (OAH). Decisions of these arbitrators, councils, boards, commissions, and Administrative Law Judges can usually be appealed by specialized litigation known as a "writ of mandamus."
