The labor lawyers of Rose Law Firm, P.C. represent public - and private-sector labor unions and employee organizations and their members, including:
- Police and sheriff’s deputies
- Firefighters, paramedics and emergency medical technicians (Attorney Joe Rose served as a California firefighter and paramedic for many years)
- Correctional officers
- Public works employees, engineers, architects, clerical, and administrative employees
- Employees of city, county, and state governments and special districts
What We Do
- Review your organization’s bylaws and practices to help you comply with federal and California law
- Provide advice and assistance with:
- Political action committee formation, including filing of initial documents
- General political consultation regarding candidates, measures, or initiatives
- Coordination of union-sponsored or union-endorsed ballot initiatives
- All areas of union business, including fulfilling the union’s duty of fair representation, agency shop elections, and agency fee protestors
- Defend union members who are facing discipline or discharge
- Draft and file union formation documents, such as articles of incorporation and bylaws
- Coordinate union recognition and bargaining unit modification
- Participate in meeting and consulting processes between unions and employers under the Meyers-Milias Brown Act
- Coordinate and participate in collective bargaining, including negotiating memoranda of understanding (MOU), side-letter agreements, and impact bargaining
- Enforce union contracts through informal steps of resolution, mediation, arbitration, or administrative hearings to prosecute administrative grievances for an employer’s breach of MOU provisions or breach of rules or policies
Prosecute or defend against administrative claims and civil lawsuits involving the union, organization, or individual members:
- Prepare you for interviews, conferences, and hearings
- Investigate to determine what evidence might exist regarding your situation
- Perform discovery to determine the factual basis of your case and identify supporting documents
- Negotiate a settlement, if appropriate
- Prosecute or defend against charges of unfair labor practice charges before the California Public Employment Relations Board
- Represent you during interviews, conferences, administrative hearings, the administrative appeals process, and before government agencies such as civil service commissions, city councils, county boards of supervisors, California Public Employment Relations Board and the National Labor Relations Board
- Represent you in mediation, arbitration, and litigation in state and federal courts, including petitions for Writ of Mandate, temporary restraining orders, injunctive relief, declaratory relief, or other plaintiff or defense litigation
- Appeal negative findings or judgments
