The most common type of wage and hour dispute involves employers improperly classifying employees as exempt from the Fair Labor Standards Act or the California Labor Code, which establish minimum wage, overtime pay, and other standards of hours of work and salary for workers.
Who We Represent
Our California wage and overtime dispute attorneys represent private-sector, government, and union employees who:
- Believe they have been misclassified as exempt (salaried) and are required to work unpaid overtime (more than 8 hours a day or more than 40 hours a week)
- Are classified as non-exempt and asked or required to work “off the clock” or through meal or rest breaks without pay
- Believe they have earned but unpaid wages due to them
- Believe they have been underpaid on wages or sales commissions (including improper commission charge-backs)
- Believe they have been misclassified as independent contractors
