Financial elder abuse and notary public negligence, jury verdict
WEST SACRAMENTO - Lawsuit by two brothers against third brother for financial elder abuse of their elderly mother. Defendant-brother arranged for reverse mortgage on mother's home and induced mother to name him as agent under a power of attorney while aged mother was in failing health and susceptible to undue inluence. Defendant-brother used proceeds of reverse mortgage for installation of a swimming pool at his home, purchase of jewelry for his wife, wedding photos, travel, to purchase a truck for himself, to pay his daughter's rent a living expenses, and made several ATM cash withdrawals. Lawsuit also named notary public for unlicensed practice of law and negligence in connection with her death-bed drafting and acknowledgment of a quit claim deed conveying mother's home to defendant-brother. After mother's death, defendant' brother threw out the mother's last will and testament leaving her estate in equal shares to the three brothers. Jury verdict for plaintiffs for financial elder abuse and reconveyance of money and property to mother's estate plus attorney's fees. Confidential settlement with notary public.

Technology workers not paid and forced to sign releases for partial wages
SACRAMENTO- Confidential settlement for several employees of a Sacramento technology firm who were not paid their wages and forced to sign settlement and release agreements to receive partial payments of wages owed to them in violation of the California Labor Code.

Landscape design manager not paid promised bonuses and commissions
EL DORADO HILLS - Confidential settlement for manager of a landscape design who was not paid promised bonuses and commissions.

Nursing home administrator unlawfully fired
SACRAMENTO - Confidential settlement for administrator of several nursing homes who was fired after complaining about illegal practices and regulatory violations.

CALIFORNIA - A confidential settlement in excess of $1M for several hundred financial analysts misclassified as exempt from overtime compensation.

San Joaquin County Sheriff's Deputy ordered reinstated with back pay
SAN JOAQUIN COUNTY - A long-term San Joaquin County Deputy Sheriff who was involved in a serious and debilitating on-duty vehicle accident was deemed permanently disabled from law enforcement under the Workers' Compensation Law but inconsistently deemed fit-for-duty by the San Joaquin County Employees' Retirement Association, resulting in discharge without any retirement benefits. The deputy's reinstatement with back pay and benefits was ordered following a petition for write of mandate under Code of Civil Procedure section 1085.

Technical writer misclassified as exempt
NORTHERN CALIFORNIA - A technical writer who was misclassified as exempt from overtime compensation had job benefits removed after complaining to the employer. Technical writer was constructively termited and former employer made deliberately false statements (including asserting the existence of a non-competition agreement that violated Business and Professions Code section 16600) to a prospective employer in violation of Labor Code section 1050, successfully preventing the technical writer from being hired. Confidential settlement.

Susanville officer cleared in criminal probe
SUSANVILLE - A Lassen County grand jury has refused to issue a criminal indictment against city of Susanville Police Officer Richard Warner in connection with Warner’s use of force in May 2002.
